1. Booking Terms

1.1 The booking form must be completed and signed by the Party Leader (the client), who must be over 21 years of age.

1.2 Signing the booking form confirms your rental, creating a contract between the owners and lead client. The lead client is solely responsible for all members of the party.

1.3 The procedures and conditions will still apply even if for any reason the booking form has not been completed by the client, e.g. In the case of a late booking, which necessitates immediate commitment.

1.4 The booking is not confirmed until the completed and signed booking form, together with the appropriate deposit has been received and the acknowledgement receipt has been issued. If the booking is not accepted for any reason the deposit will be refunded in full.

1.5 The accommodation cannot be shared assigned or sublet and only persons named on the booking form are permitted to stay in the property (by Florida State Law).

1.6 Persons and children under the age of 18 years are not acceptable unless accompanied by a parent or parents or a responsible adult (over 21).

1.7 Smoking and Pets are forbidden within the premises of the villa.

1.8 Any infringements of these conditions may result in the bond being withheld.


2. Payment

2.1 The person who signs the booking form is responsible for all payments in respect of the booking.

2.2 Bookings will be confirmed upon return of the Booking Form along with payment of a deposit of £100/US$180 per week (or part of).

2.3 Deposit payments are due within 7 days of any initial telephone booking; failure of this will result in your chosen date being released.

2.4 The balance plus appropriate security bond is due no later than 10 weeks prior to the commencement of rental.

2.5 Should payment not reach us by the stated time, we reserve the right to cancel the booking and you will be liable to pay cancellation charges set on the scale below, see "Cancellation by the Client 5.2".


3. The Security Bond

3.1 The client is solely responsible for any damages or breakages caused to the property or to its contents. Any loss of items in the inventory during their stay is a breach of the rental agreement.

3.2 The owners have the right to withhold all or part of the £200/US$360 (per booking) security bond to cover any damage to the property or its contents or any charges which the guest may incur during their stay.

3.3 The villa is inspected both before and at the end of each occupation, dependent on this report the security bond will be returned, within 21 days.

3.4 Guests who leave doors and or windows open, resulting in an excessively high energy bill may forfeit all or part of their security deposit. 

3.5 In the event of and damage or loss exceeding the security bond, the lead client is held fully responsible for full reimbursement, within 21 days of your return. Breach of this will result in taking action with the appropriate County Court.

3.6 If the villa is left in an unacceptable condition for the next client, a further US$250.00 for a deep clean will be enforced.


4. Amendments

4.1 Amendmentís to the booking are only accepted when received and responded to in writing.

4.2 Whenever possible any amendment to the booking requested after the booking has been confirmed, will be accommodated dependant on the nature of the amendment (additional costs may be incurred).


5. Cancellation by the Client

5.1 Any cancellation by the client must be notified in writing or e-mail directly to the Owners, telephone cancellations will not be accepted.

5.2 In the event of cancellation by the client, the following charges will apply:

       Any time after acknowledgement receipt has been issued - Loss of deposit

       6-8 weeks before arrival  - 25% of total price (Plus deposit already received)

             4-6 weeks before arrival  -50% of total price (Plus deposit already received)

       Within 4 weeks of arrival - 100% of price (Plus deposit already received)


6. Cancellation by the Owners

If for any reason the owners need to cancel the booking, they will refund any moneys paid by the client, without interest, compensation or sub sequential loss of any kind.


7. Price Guarantee & Rental Charges

7.1 The rental price for the villa is guaranteed when the deposit has been paid and the acknowledgement receipt has been issued.

7.2 The villa rental charges and the items included are as agreed by the client and the owners at the booking procedure stage.


8. The Rental Period

8.1 Reservations normally run from Saturday to Saturday and are for a minimum of 7 nights (other than by arrangement)

8.2 The Villa is available for occupation from 4.00 p.m. (local time) on the day of arrival until 10.00 a.m. on the day of departure. Vacating after 10.00 a.m. may incur charges equivalent to one nights occupation cost.


9. Unacceptable Behaviour

9.1 The owners and the Management Company reserve the right to instruct all guests to vacate the property, without notice, in the event that there should be any incidents deemed to be act(s) of unacceptable behaviour, misconduct, lack of consideration and attention, or malicious intent.

9.2 The owner and the management company will not be liable for any loss to any guests as a result of this unfortunate action.


10. Smoking

Smoking within the villa will result in the total loss of your security deposit and if discovered before your departure your party will be required to leave without compensation.


11. International Travel Requirements

11.1 Clients are personally responsible for the provision of adequate Travel/Health Insurance and International Travel Documentation.

11.2 Cancellation by clients due to incorrect documentation will be charged the relevant cancellation fees.

12. Alarm/Entry System

12.1 Guests must ensure that the villa doors are securely and properly locked when leaving the villa.

12.2 Guests must ensure that alarm system is correctly activated each time they leave the villa.


13. Pool /Spa

13.1 The Pool water is heated by a "Heat Pump" this device takes heat from the outside air and uses it to heat the pool. Therefore the water will only be approximately 10 degrees higher than the outside temperature.

13.2 Pool heating is recommended between the months of October and April.

13.3 In the event of the pool heater malfunctioning, or other circumstances beyond our control, the agent will do their utmost to rectify the problem as soon as possible. In such an event liability will be limited to refunding the pool heat payment for the number of days the heater was out of order, provided the management company was informed immediately. No other compensation shall be paid.

13.4 Guests will be charged for damage caused by unauthorized tampering to the pool valves, timer, or other controls outside of the screened area.

13.5 No glassware is to be taken into the pool area. If glass is broken and gets into the pool it must be completely drained and re-filled, this cost will be passed on to the guest.


14. Pool Alarm:

The Patio Door and the Door from the Master Bedroom are both alarmed as per Florida Law. Any tampering with or damage to the Alarm System will result in the loss of Security Bond.


15. Force Majeure

The Owners and their representatives accept no financial responsibility for any changes, or cancellations to bookings for reasons beyond their control. These include; war or threat of war, riots, civil commotion, terrorist activities, industrial disputes, natural disasters, fire, flood, adverse weather conditions, technical problems with transportation, closure or congestion of airports, alterations or cancellation of schedules by carriers.


16. Complaints

16.1 In the unlikely event of any complaints during your stay, please contact the Management Company immediately. If the situation was not reported straight away to the Management team, the owners reserve the right not to accept any responsibility.

16.2 Any further complaints must be addressed in writing to the owner within 14 days of returning from your holiday.


17. Brochure Description

Whilst all information supplied in the brochure and or website is deemed to be correct, it is understood that the information supplied is for guidance purposes only and does not form part of any contract.


18. House Rules

18.1 All doors and windows shall be closed and secured whenever the guests are not in the property.

18.2 All external doors and windows should not be left open at any time.

18.3 Please ensure the trash is put out for collection the night before a collection day (See renters guide for trash collection days).

18.5 If guests are seen to have moved furniture, they will be responsible for any damage caused to he villa and furniture in this process.

18.6 Due to sub division laws guests are NOT allowed to park on the road.


19. Telephone

The property is provided with a telephone that provides a free incoming call service as well as free use for local (863) and emergency (dial 911) calls, along with US and Canada. All international calls are to be paid for by the guest, through the use of a pre-paid phone card, available at local stores or gas stations. If the owners receive any additional phone charges incurred during the rental period. These charges will be deducted from the security deposit.


20. WC/Toilet

US waste pipes are relatively smaller compared to other countries and can easily become blocked, plungers are provided for this purpose. However, if the management company is called out to unblock the toilets, there will be a mimimum charge to the guest of US$60.


21. Limitation of Liability

Although every effort is made to ensure that the villa is in perfect condition, the Owners cannot accept responsibility for any claims, accidents, damage, or loss of property, or for any expenses incurred for any reason, including changes caused by Force Majeure, regardless of howsoever they have occurred, nor can liability be accepted for injury as a result of the use of the swimming pool/spa, howsoever caused. Guests are specifically advised not to allow unsupervised children access to the staircase and balcony area or the pool/spa and surrounding area.


22. Law

This contract shall be governed by and construed in accordance with English Law, and any dispute arising out of, or in connection with, the terms of this contract shall be subject to the exclusive jurisdiction of the English courts.


23. Eviction

Owners or Management company reserve the right to evict any clients who are in breach of any of the terms and conditions without notice.
